At Cultura Law we try our best to help people who have been victims of crimes here in the United States. Both legal and illegal immigrants who are victims of certain crimes in the United States and those that are victims of human trafficking have options available to them so that they can come out of the shadows and become members of society.

 

Whether a person is legally in the United States or not they are entitled to certain rights and protections. They have rights in Family law and they have protections that allow them to report their crimes without fear that the government will retaliate against them. In addition there may be a pathway towards legalization and citizenship for many of those victims. 

 

VAWA - This program allows people who are victims of Domestic Violence to apply for a work permit and permanent residency if they were abused by their United States Citizen or Legal Permanent Resident spouse (husband or wife). To qualify victims must establish that they:

 

  • Have or had a qualifying relationship with the abuser spouse, or, are the parent or child of the abuser,

  • Reside or resided with the abuser,

  • Have good moral character, and

  • Have been victims of battery or extreme cruelty.

T-Visa- This program is aimed towards providing protection to those people who have been victims of Human Trafficking. Human Trafficking is a kin to modern day slavery. If you or someone you know fits the description below please contact Cultura Law or the Department of Homeland Security. To qualify victims are not required to be in legal immigration status, but they must:

 

  • Be a victim of a severe form of trafficking in persons,

  • Be physically present in the United States on account of the trafficking,

  • Comply with any reasonable requests for assistance in the investigation or prosecution (or be under the age of 18), and

  • Suffer extreme hardship involving unusual and severe harm if removed from the United States.

U-Visa- This program is geared towards helping victims of certain crimes who cooperated with law enforcement to obtain work authorization and a temporary visa. This program also has a pathway towards citizenship available. To qualify victims must establish that they:

  • Be a victim of qualifying criminal activity and have suffered substantial physical or mental abuse as a result of the crime

  • Possess credible and reliable information about the qualifying criminal activity

  • Be, have been, or are likely to be helpful to the investigation and /or prosecution of that qualifying criminal activity, and

  • ·Be a victim of criminal activity that violated a U.S. Law 

 

En Cultura Law intentamos nuestro mejor para ayudar a las personas que han sido víctimas de delitos aquí en los Estados Unidos. Los inmigrantes tanto legales como ilegales que son víctimas de ciertos delitos en los Estados Unidos y aquellos que son víctimas del tráfico en humanos tienen opciones a su disposición para que puedan salir de las sombras y se convierten en miembros de la sociedad.

Si una persona está en los Estados Unidos tienen derecho a ciertas protecciones. Ellos tienen derechos de familia y tienen protecciones que permitan denunciar sus delitos sin temor a que el gobierno va tomar represalias contra ellos. Además puede ser un camino hacia la legalización y la ciudadanía para muchos de las víctimas.   

 

VAWA - este programa permite a las personas que son víctimas de violencia doméstica puedan solicitar un permiso de trabajo y residencia permanente si fueron abusados por su cónyuge ciudadano de los Estados Unidos o residente permanente Legal (esposo o esposa). Para calificar a las víctimas que deben establecer:

  • Tiene o tuvo un matrimonio con el cónyuge abusador, o eres el padre o hijo del abusador Y

  • Reside o residía con el abusador,

  • Usted debe tener buen carácter moral,

  •  Y haber sido víctimas de la abuso o crueldad extrema.

 

 T-Visa-este programa está dirigido a brindar protección a aquellas personas que han sido víctimas del tráfico en humanos. Trafico es un tipo de esclavitud moderna. Si usted o alguien que usted conoce se ajusta la descripción a continuación póngase en contacto con Cultura Law o el Departamento de seguridad nacional. Para calificar las víctimas no tienen que estar en estado migratorio legal, pero deben:

 

  • Ser víctima de una forma severa de tráfico de personas,

  • Estar físicamente presentes en Estados Unidos por el tráfico,

  • Cumplir con cualquier solicitud razonable de asistencia en la investigación o el enjuiciamiento (o ser menores de 18 años)

  •  Y sufrir dificultades extremas que implican daño inusual y grave si extraen de Estados Unidos.

 

U-Visa-este programa está dirigido a ayudar a las víctimas de ciertos delitos que han colaborado con la ley. Pueden obtener una visa temporal y autorización de trabajo. Este programa también tiene un camino hacia la ciudadanía disponible. Para calificar a las víctimas debe establecer que ellos:

 

  • Fueron víctima de un crimen o actividad que califica para el programa;  

  • Han sufrido abuso físico o mental sustancial como resultado del delito

  • Poseen información importante y confiable sobre la actividad criminal,

  • han sido o son propensos a ser útil a la investigación o enjuiciamiento de esa actividad criminal que violó una ley estadounidense
